I. General provisions

  1. These Terms and Conditions are addressed to Entrepreneurs and define the rules and procedures for transactions in the ALSANIT Sp. z o.o. Online Store, available at: http://alsanit.nl/winkel, operated by the Seller.
  2. Whenever terms are used in these Terms and Conditions, they shall be understood as follows:
  1. Seller/Administrator – ALSANIT Sp. z o.o., with its registered office in Trzcianka (64-980), ul. Wieleńska 2, POLAND. REGON number 521032169, NIP (Tax Identification Number) 763-214-68-59, and KRS (National Court Register) number 0000948140.
  2. Store – the online store operated by the Seller, available at http://alsanit.nl/winkel
  3. Customer – a legal entity or an organizational unit without legal personality, granted legal capacity under specific provisions, placing an order via the online store. The buyer in the online store may also be a natural person conducting business activity and registered in the Central Register of Business Activity (CEIDG);
  4. Order fulfillment time – the number of days within which the Seller will complete the placed order;
  5. Order – a declaration of the Customer’s will specifying the goods presented in the Store and their quantity, constituting an offer made by the Customer to the Seller via the Store to conclude a sales contract for the ordered goods;
  6. Goods – products offered by the Seller for retail sale, available in the Store;
  7. Supplier – a courier company cooperating with the Seller or Poczta Polska (Polish Post);
  8. Business days – means weekdays from Monday to Friday, excluding public holidays;
  9. Password – a sequence of letters, numbers, or other characters selected by the Customer during registration in the Online Store, used to secure access to the Customer’s account in the Online Store;
  1. The information provided on the Store’s website does not constitute an offer within the meaning of the provisions of the Civil Code. It serves as an invitation to submit offers by Customers within the meaning of Article 71 of the Act of April 23, 1964, Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended).
  1. Product availability is updated from Monday to Friday in the evening hours, excluding public holidays. The fulfillment of all orders depends on product availability. In case of delivery issues or product stock shortages, we reserve the right to inform the customer about the possibility of ordering substitute products of the same or higher quality and value, which the customer may choose to order. If the customer is not interested in substitute products, we will refund all costs paid by the customer.
  1. The Seller reserves the right to limit the quantity of goods available for order in the Store at promotional prices.
  1. Invoices are issued and sent electronically to the email address provided by the Buyer in the order. The Buyer may provide an alternative email address for receiving
    invoices. In such a case, all
    invoices for the current and future orders will be sent to the designated email address for electronic invoices. The electronic invoice is considered received once sent by the Seller exclusively from the email address: sprzedaz@alsanit.pl. If the Buyer does not wish to receive electronic invoices, they may object within 7 days from the date of concluding the contract. In such a case, the Seller is obliged to deliver invoices to the Buyer in a traditional paper form..
  1. All Goods presented in the Store are brand new.

II. Registration in the store and placing orders

  1. Customers eligible to place orders for Goods are:
  1. those holding the status of a registered user of the Store,
  2. those without the status of a registered user – making purchases without registration or login procedures (guest checkout).
  1. The status of a registered user is obtained by correctly completing the registration form available on the Store’s website (providing the required personal data and setting a password).
  1. Registration in the Store is voluntary, free of charge, and performed once.
  1. To complete the registration process, the Customer must review these Terms and Conditions and consent to the processing of their personal data provided during registration for the purpose of creating an account, processing, and managing orders placed in the Store. This consent is voluntary but necessary to complete the registration.
  1. Orders can be placed 24 hours a day, 7 days a week, via the website http://alsanit.nl/winkel or by email at: sklep@alsanit.pl.
  1. For orders placed via email, a complete order should include: the name of the product(s) with their codes, quantities, and selected color (if the product has multiple color versions); full shipping details – recipient’s name and surname, delivery address (street, house/apartment number, postal code, city), and contact phone numer; chosen payment method – cash on delivery or bank transfer; details for issuing a VAT invoice.
  1. Upon placing an Order, a sales contract for the Goods is concluded. After placing the Order, the Customer receives an email with an order summary, which confirms that the Order has been registered in the Store.
  1. Placing an order constitutes acceptance of all provisions of these Terms and Conditions and consent to the processing of personal data for the purpose of fulfilling and handling orders placed in the Store.
  1. The Seller reserves the right to conduct additional verification of the Customer’s data, e.g., via telephone contact.

III. Order fulfillment, delivery, and costs

  1. Orders are processed only on business days. Orders placed on Saturdays, Sundays, and public holidays are processed on the first business day.
  2. The order fulfillment time is from 2 to 14 business days, counted from the moment the payment is credited to the Store’s account (in the case of traditional payment or bank transfer). For cash-on-delivery orders, the fulfillment time is up to five business days, counted from the moment the Store confirms the order by phone.
  3. If the order number is missing or incorrectly stated in the bank transfer title, the order fulfillment period may be extended.
  4. Orders for products marked as “made to order” are typically fulfilled within 60 calendar days. If a longer waiting period is required, the customer will be informed by email about the actual fulfillment time.
  5. The Customer may modify the order until the sales document is issued. The Customer may cancel the entire order until it is shipped. These changes can be made by contacting the Store at +48 67 253 23 60 or by email at sklep@alsanit.pl
  6. The Seller reserves the right to refuse order fulfillment in cases of:
  1. orders placed using an incorrectly completed order form,
  2. orders placed in violation of these Terms and Conditions
  1. Orders are fulfilled and delivered to the address provided by the Buyer during the conclusion of the contract. Deliveries outside the territory of the Republic of Poland require an individual shipping cost calculation. The Customer must confirm the cost and make a prepayment to the account before the order is shipped.
  1. The delivery time depends on the delivery location and the chosen shipping method. Shipments are carried out by a courier service or Poczta Polska (Polish Post).
  1. Shipments are delivered from Monday to Friday during the hours specified in the respective courier or postal service regulations. In the event of the recipient’s absence, a delivery notice (awizo) with all necessary information for package collection will be left in the mailbox.
  1. Shipping costs depend on the selected delivery method and payment method.
  1. If the Customer notices that the package is damaged upon receipt, they should act in accordance with the relevant provisions of the Postal Law Act of July 23, 2003. It is recommended to prepare a damage report in the presence of the courier and refuse to accept the damaged goods.

 


IV. Prices of goods and payment methods

  1. Prices for all products presented in the Store are quoted in Polish zloty (PLN) and euro (EUR), excluding VAT and shipping costs.
  2. The price displayed next to the product at the time of placing the order is binding for the Customer, unless otherwise agreed by both parties.
  3. Product prices may change, but such changes do not affect orders placed before the new prices take effect.
  4. The Customer purchasing from the Store may choose one of the following payment methods:
  1. bank transfer or deposit to the Store’s bank account. For bank transfers or deposits to the Seller’s account, the transfer title should include: – customer’s full name and company name, – order number (as provided in the emailed order summary). Payments should be made to the following account numbers: PL 04 1020 3844 0000 1602 0008 7361 or EUR PL 69 1020 3844 0000 1402 0147 0673. Bank: Powszechna Kasa Oszczędności Bank Polski S.A.
  1. Customers who choose to pay via traditional bank transfer must complete the payment within 7 days from the order date. Otherwise, the order will be canceled. The payment deadline may be extended upon prior approval from the Store.

V. Complaints

  1. The Seller is legally obliged to deliver Goods to the Customer free from defects.
  2. The Seller is not liable for non-conformity of consumer goods with the contract if the Customer was aware of the non-conformity at the time of concluding the contract or, reasonably assessing the situation, should have been aware of it.
  3. If the Buyer decides to exercise their right to file a complaint, the following provisions apply.
  4. The Buyer must properly complete the COMPLAINT FORM (attached to the order summary email), sign it, and send it together with the claimed product and proof of purchase to the address stated in the form.
  5. The complaint will be reviewed within 14 days from the date of submission. The Customer will be informed of the decision via email or phone. If the Customer has not provided an email address or phone number, the Seller will notify the Customer in writing (to the address provided during the contract conclusion).
  6. The direct costs of returning the claimed goods to the Seller are covered by the Customer. The costs of shipping the repaired or replaced goods back to the Customer are covered by the Seller. The Seller does not accept shipments sent with the “cash on delivery” (COD) option.

VI. Withdrawal from the Contract

  1. Since contracts are concluded exclusively between entrepreneurs, the right to withdraw from the contract applies only if the contract is concluded by an
    entrepreneur conducting a sole proprietorship, and the contract is not directly related
    to their business or professional activity.
  2. The declaration of withdrawal from the concluded contract must be submitted in writing within 14 days from the date of receiving the subject of the contract, unless the contract concerns goods produced according to the consumer’s specifications or clearly personalized.
  3. To meet the withdrawal deadline, it is sufficient to send the declaration of the right to withdraw from the contract before the withdrawal period expires. The declaration can be sent to the Seller’s address or via email to: alsanit@alsanit.pl.
  4. In the event of withdrawal from the contract, the Customer is obliged to return the goods within 14 days from the date of submitting the withdrawal declaration. The cost of returning the goods is borne by the Customer.

VII. Personal Data Protection

  1. By registering in the Store, the Customer consents to the collection and processing of their personal data provided in the registration form by the Seller. The Administrator collects and processes personal data in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
  2. The Customer may consent to the processing of their personal data for marketing purposes, including receiving newsletters with commercial information.
  3. The Customer has the following rights regarding their personal data: access their personal data (including obtaining a copy), rectify their personal data, request deletion of their personal data, object or restrict to the processing of their personal data, exercise the right to data portability.
  4. The rules for processing and protecting personal data in the online store are available in the privacy policy section on the website: https://www.alsanit.nl/privacybeleid.

VII. Final Provisions

  1. The language governing contracts concluded via the Store is Polish. The Seller allows contracts to be concluded in English or German; however, in case of any doubts or discrepancies, the Polish version of the Terms and Conditions shall prevail.
  2. In all matters not regulated by these Terms and Conditions, the applicable national laws of the Seller’s country shall apply.
  3. In the event of a dispute arising between the parties to the contract, the competent court shall be a Polish court with jurisdiction over the Seller’s registered office.
  4. These Terms and Conditions come into effect upon publication on the Store’s website.
